Notice of Public Hearing
To: The Residents and Property Owners of Monitor Township
Notice is Hereby Given that the Monitor Township Planning Commission will hold a public hearing on Tuesday, August 3, 2021 at 7:00 p.m. at the Monitor Township Hall, 3567 7 Mile Rd., Bay City, Michigan, to consider the request of Schott and Jana Rezmer, of 5469 Fraser Road, Bay City, Michigan 48706 to have the standards of a residential accessory building modified to enable them to acquire additional property which has a previously utilized agricultural accessory building on it. This accessory building is greater in size than would normally be permitted on a residential lot of the size of the Rezmer property and is also closer in proximity to the proposed property line than would be allowed by the Township Zoning Ordinance being Ordinance 67 of Ordinances. The Zoning Ordinance permits the Planning Commission to grant a waiver in certain circumstances to the strict regulations of the Zoning Ordinance regarding accessory buildings. The parcel of property is approximately .44 acres, which entitle the occupants of that property to have a maximum accessory building of 1,200 square feet, which would need to be less than 90% of the dwelling area of the home and would be required to be at least 15 feet from the property line. This particular barn to be attached to their property is 2,400 square feet which is far greater than what is permitted by the Ordinance and would likely only be 16 feet from the property line which, per the Ordinance requires a building that size to be 40 feet from the property line.
The property is located within Monitor Township, County of Bay, and State of Michigan, Parcel Number 09-100-028-100-101-01 and is generally located at 5469 Fraser Road, Bay City, Michigan 48706.
Alternatively, the Planning Commission could consider this request as a split of previous agricultural buildings to be severed from the agricultural property. However, there are three (3) agricultural buildings located on the farm and these applicants are only seeking to purchase one (1) of the agricultural buildings. Pursuant to the Zoning Ordinance, if this is to be considered a split of previous agricultural buildings to become residential accessory buildings, the other two (2) buildings would not be allowed to be split from the farm property in the future.
You are welcome to attend and inspect the proposed site sketch etc. at the Monitor Township Hall, 2483 East Midland Road, Bay City, Michigan, Michigan, between the hours of 9:00 a.m. to 12:00 p.m. and 1:00 p.m. to 3:00 p.m., Monday through Friday, excluding holidays. During those hours, written comments will be received at the Monitor Township Office prior to the time of the hearing.
The Charter Township of Monitor will provide necessary reasonable auxiliary aids and services, such as signers for the hearing impaired and readers for printed materials being considered at the hearing, to individuals with disabilities who are present at the hearing, upon ten days’ notice.
