To:  The Residents and Property Owners of Monitor Charter Township


Notice is Hereby Given that the Monitor Township Zoning Board of Appeals will hold a public hearing on Thursday, October 20, 2022 at 7:00 p.m.  at the Monitor Township Hall, 2483 East Midland Road, Bay City, Michigan, to consider the request of Rev LNG, LLC, lessee of property commonly referred to as 3900 S. Three Mile Road, Bay City, Michigan 48706, having parcel number 100-011-400-030-00 to interpret and determine the application of a certain section of the Zoning Ordinance as it applies to this parcel of property.  The applicant operates a natural gas production and processing facility pursuant to a special use permit granted by the Township Planning Commission several decades ago.  The applicant now requests an opportunity to expand the special use and remove from the pipeline located on the property, natural gas that will then be trucked off site and utilized for purposes off site.  The Township Zoning Ordinance, being Ordinance 67, as amended, allows pursuant to Section 5.03(m) natural gas production and processing facilities when granted a special use permit by the Planning Commission but said facilities does not include treating, separating, hydrogen sulfide processing, or refining of said gas, but strictly limited to dehydration, metering, and required separation for the metering process only.


The property described above is zoned agricultural and as previously stated, does have in fact a processing and production facility pursuant to a special use permit.  The question is whether said parcel of property can be utilized for removing of natural gas for off site purposes.  The Ordinance may need interpretation and pursuant to State Law and the Ordinance provisions itself, specifically Section 18.02(a), the Zoning Board of Appeals is vested with the decision making authority regarding any question involving the interpretation of any provisions of this Ordinance.


All documents are available for inspection at the Monitor Township Hall, Monday through Friday, 9:00 a.m. to 11:00 a.m. and 1:30 p.m. to 3:30 p.m., excluding holidays.  You are welcome to attend the hearing.  Written comments will be received at the Monitor Township Hall, 2483 East Midland Road, Bay City, Michigan and must be received on or before the hearing.
